Elder Law: Meeting the Legal Needs of Older People and Their Families

Elder law refers to a variety of legal services that focus on the needs of senior citizens and their family members. It also refers to the needs of disabled children and adults.

In addition to estate planning, the attorneys of The Bagert Law Firm work with a variety of legal tools to meet the wide-ranging needs of their older and disabled clients. We keep abreast of governmental benefits such as Medicare and Medicaid in order to assure the best level of client care while protecting against the unnecessary expenditure of client assets. Where appropriate, we establish guardianships to protect our clients and to empower family members to act on their behalf. We handle estate planning issues, which can include wills, living wills, powers of attorney, and trusts. We help clients plan for when and how to transfer their ownership of a business, their investments and their real estate holdings.

Asset Preservation and Long Term Care

Our elder law practice includes planning for long-term care needs, such as nursing home care. We will help clients find legitimate ways to preserve their assets as much as possible. In some cases, this may mean establishing a grantor trust in which assets can be transferred to the trust so that a client can be eligible for Medicaid payment of nursing home costs. After death, the trust repays Medicaid.


Special Needs Trusts

Our lawyers frequently represent parents of children who have special needs. We use a variety of estate planning tools to help clients reach their specific goals. In some cases, that may mean establishing a trust so that the special needs child can receive government benefits, such as Medicaid. As president of a non-profit organization dedicated to serving the needs of children with disabilities in New Orleans, Bernard J. Bagert, Jr. understands the issues families face and uses his legal knowledge to help them accomplish their goals.
